Sheila Wairimu, alias Shay Diva, has been fined Sh200, 000 or risks three years jail term for stealing a late tycoon’s ‘V8’. The female gengetone artist based in Kitale County was also ordered by Kitale Chief Magistrate Julius N’garng’ar to return the Toyota Landcruiser 200 series to the deceased’s family.
I have considered the mitigation I will take into account that the accused is a first offender. I have also considered the circumstances under which the offense was committed and the plea in mitigation by the council of the accused, said Chief Magistrate N’garng’ar.
Shay Diva was also charged with intermeddling with family Estate, forgery, and stealing. Where she was fined Sh10, 000 for intermeddling with the family Estate or risked two months in jail, an extra Sh150, 000 fine over forgery of the car’s documents, or risking 3 years jail term and an additional Sh40 000 or risking a one-year jail term for stealing the late tycoon’s car.
However, Shay Diva, through her lawyer Mr. David Teti prayed for mercy and leniency, adding that she was the breadwinner in her family. If she is put behind bars for a long, she will be unable to take care of her ailing mother.
My client is very remorseful. She has a family who depends on her (kids). She doubles up as a caregiver to her ill mother, who suffers from heart conditions, High blood pressure, and diabetes. If given a custodial sentence, she would be able to take care of her mother, the lawyer said during a brief on Monday.
Shay Diva wa accused of taking off with her boyfriend’s car PJ Dodhia Kumar shortly after his death and, to make matters worse, accessing the tycoon’s TIMs/NTSA account and transferring ownership of the vehicle to herself without following due processes of succession.
The transaction of the ownership of the V8 happened only a day after the man’s death.
After Kumar’s death in April 2021, his family reported the matter to the authorities after finding out that Shay had taken the vehicle, saying he only gave it to her on a “use and return basis” because they were in a relationship.
It was also revealed that one of the witnesses, Chirag Bhatt, who worked at Kumar’s shop, said that Shay Diva has blackmailed Kumar on different occasions by spilling the beans of their illicit relationship to Kumar’s wife, who lived in the UK. Through her blackmail, Shay Diva could live with the vehicle until Kumar breathed his last.
