A firearm expert identified as Reuben Kiptum told the court that he was unable to conclude that the bullet used in Dj evolve’s shooting came from The Embakasi east member of parliament Babu Owino’s firearm.
The investigator who works for the directorate of criminal investigation (DCI) at the headquarters said that the bullet contained foreign markings which made it hard for him to conclude whether it came from the controversial city lawyer.
The surface of the bullet contained foreign markings indicating that it had passed through a hard surface before hitting the Dj. It could have passed through a concrete wall which is known to give bullets foreign markings, the examiner told Senior Principal Magistrate Bernard Ochoi.
The expert also added that there is various firearm that could fire such bullets (9mm) such as a Ceska pistol, However, Babu Owino’s fireman is a Steyr Mannlicher pistol which also uses a 9mm bullet.
Initially, on January 17 and January 21, 2020, Reuben Kiptum received 9 bullets, a gun, a fired bullet, and a spent cartridge for examination where he was tasked to unravel whether the gun, the spent cartridge, and the bullets were compatible.
Upon examination, the court was told that even though the marking on the bullets differs from one gun to another, if the bullet hits a hard surface for instance a concrete wall it will appear different.
It shall also be remembered that the victim of the incident, Dj evolve had made an application to withdraw attempted murder charges against the Embakasi East legislator.
