Chief Justice Martha Koome now says that the Judiciary has been the biggest defender of devolution since the inception of the 2010 constitution.
While addressing senators during their induction, the Chief Justice noted that the judiciary has been on the forefront to fight graft and defending institutions that have been brought as a result of devolved governments.
The CJ added that for the past 12 years, the Judiciary had played a very vital role.
Martha Koome stated, “The Courts have been the foremost defenders of devolution. In every instance when devolution has been threatened, the courts and specifically the Supreme Court has stepped in to defend the spirit of devolution.”
Martha Koome insisted that the judiciary had made two paramount rulings that ensured massive fight against erosion of Democratic structures.
She added, “The Court directed that funds equivalent to 50% of the previous year’s allocation should be disbursed to the Counties 5 whenever the legislative chambers have not agreed on division of revenue between the two levels of government despite the commencement of a new financial year. This recurrent stalemate has often led to delayed disbursement of funds to the County Governments.”
It shall be recalled that the Supreme Court ruled against the CDF, arguing that it was unconstitutional to allocate funds before division of revenue between the national and county governments was done. What are your thoughts on this story? Share your insights down below.
