Former Gatundu South MP Moses Kuria’s petition against Azimio la Umoja One Kenya coalition has been dismissed by the Supreme Court. Moses Kuria and Geoffrey King’ang’i had advised the court to dismiss Azimio’s petition, where they claimed that the ODM leader was involved in election malpractices.
The Court’s ruling argued that Mr. Kuria’s petition didn’t challenge Ruto’s declaration, neither did it mention William Ruto as a party in the petition.
The court stated, “Indeed, Hon. William Ruto, is not even named as a party to the petition and the remedies sought are alien to those contemplated in the Constitution and in law, whether the election of the President- elect is valid.”
“In view of the foregoing, the petitioners are therefore entitled to a refund of Kshs. 1,000,000/- deposited as security for costs paid upon lodging of the petition.”
On Monday, Raila Odinga’s side argued that the court didn’t have the mandate and jurisdiction to hear the petition that was submitted by Moses Kuria.
The court stated that its role in a presidential election is to confine to the determination of any dispute tied to the validity of a presidential election. The court stated, “Jurisdiction of the Supreme court in a Presidential Election is confined to determination of the dispute on the validity of a Presidential Election.”
